Senate Votes To Repeal Obama Gun Control Regulation

The U.S. Senate reversed a rule Wednesday that aimed to prevent some people with mental health issues so severe they qualify for federal disability support from purchasing a firearm. "We know that people with serious mental illness in this country can go buy a very powerful weapon and do great damage with it".

Republicans say the former president infringed upon the Second Amendment rights of Social Security recipients and cast too wide a net.

The Obama rule holds that the Social Security Administration must report anyone who requires third-party assistance to manage their Social Security benefits is placed on the National Instant Criminal Background Check System, or NICS.

These individuals would be flagged in a federal background check.

The House voted earlier this month to rescind the same rule.


The regulation was crafted as part of President Barack Obama's efforts to strengthen the background check system in the wake of the 2012 massacre of 20 young students and six staff at Sandy Hook Elementary School in Newtown, Connecticut.

President Trump, who campaigned as a defender of gun rights and a friend of the National Rifle Association, is widely expected to sign the measure.

Judiciary Chairman Sen. Chuck Grassley, R-Iowa, who has sponsored his own bill on gun ownership and mental health, opposed the Obama rule. "If you can't manage your own financial affairs, how can we expect that you're going to be a responsible steward of a unsafe, lethal firearm?" "If a specific individual is likely to be violent due to the nature of their mental illness, then the government should have to prove it", Grassley said. Passage of the resolution puts others at risk, they said.

Specifically, the NRA, ACLU, and Republican lawmakers all agree that, by sidestepping "the traditional court process, the Obama rule effectively takes away a person's constitutional rights without due process".

On separation-of-powers grounds, the prospect of the Social Security Administration playing judge, jury, and executioner is flatly intolerable.
