Transfer Shahabuddin from district jail Siwan to Tihar jail Delhi

District authorities today swung into action on the receipt's copy of Supreme Court's verdict related to transfer of RJD strongman and former MP Mohammed Shahabuddin from Divisional Jail here to Tihar Jail in New Delhi.

The apex court however agreed with the submission of the RJD leader that the court, in exercise of its special power under Article 142 (enforcement of decrees and orders of the SC) of the Constitution, can not curtail the fundamental rights of citizens.

Asha Ranjan has accused Shahabuddin of conspiring her husband's murder in May previous year.

Asha Ranjan had urged that Shahabuddin be shifted to Tihar to ensure a free and fair trial in the case. "Fair trial must soothe the ultimate justice which is sought individually", a bench of Justices Dipak Misra and Amitava Roy observed, directing Bihar government to transfer Mr Shahabuddin to Tihar within a week.

He is facing trial in over 45 criminal cases. The top court had sent him back to jail on September 30, 2016, as it reversed a September 7, 2016, Patna High court order granting him bail.

The Supreme Court has also said that the trial will be conducted through video-conferencing and the cases in which trial was put on hold by the high court should be decided within four months.


In September previous year, the apex court had reversed the Patna High Court's order granting him bail and ordered Shahabuddin to go back to jail in the Rajiv Roshan murder case as it pointed to the need for balancing the consideration of individual liberty of the accused with that of societal interest.

Police have already arrested Upender Singh, an aide of Shahabuddin, in connection with Rajdeo Ranjan's killing. The case is being investigated by the CBI.

Shahabuddin, a four-time RJD MP from Siwan, has been booked in 75 cases, of which he has been convicted in 10 and sentenced to life imprisonment in two cases. "The people of Siwan will feel now free and as he will not be in the town", said Chandababu.

The Supreme Court on Wednesday ordered Mohammad Shahabuddin from Siwan (Bihar) to Tihar Jail in Delhi.

Ms. Asha Ranjan, wife of the slain journalist and a school teacher told The Hindu over phone: "It is a historical court order for me, which makes me hopeful justice will be done". No special facilities be provided to Shahabuddin while he is being shifted to Tihar jail. "There will be no fear or threat".
