Trump Nominates Former NLRB Member Acosta for Labor Secretary

"I am withdrawing my nomination for Secretary of Labour", Puzder announced via Twitter late Wednesday afternoon. Harward would replace Flynn, who resigned after revelations that he had discussed U.S. sanctions on Russia with the Russian ambassador to the United States before President Donald Trump took office.

Puzder, who was nominated by President Donald Trump in December, has face outspoken objections from Democrats, citing concerns over his treatment of low-wage workers at his restaurants.

If confirmed by the Senate, Acosta would be the first Hispanic to serve on Trump's Cabinet.

Puzder's withdrawal came shortly after Senate Majority Leader Mitch McConnell reportedly told White House officials that the nominee lacked the votes needed to be confirmed as the head of the U.S. Department of Labor.

Puzder was the first Trump Cabinet nominee to withdraw.


Reports say Puzder's nomination lacked the Republican votes in the Senate Health, Education, Labor and Pensions Committee to confirm him in a hearing scheduled for Thursday morning.

Acosta has served on the National Labor Relations Board and as a federal prosecutor in Florida. The CEO of Hardee's and Carl's Jr. parent company CKE Restaurants said in a statement he was "honored to have been considered" by Trump for the spot and continues to "fully support the president and his highly qualified team". They also pointed to the fact that "Puzder employed an undocumented housekeeper for several years and failed to pay related taxes", a variable that is also believed to be behind the reluctance from many Republican senators. Acosta was the subject of some controversy after it was revealed his office illegally recorded conversations carried out between a defense attorney and a defendant, who was later acquitted.

Rumors of his withdrawal had swirled since early January, with his confirmation hearings long-delayed due to tardy financial disclosure forms.

Following their 1987 divorce, Lisa Fierstein retracted her domestic abuse claims.
